Robert D. Kraus

Robert Kraus is a founding and managing partner of Kraus & Zuchlewski LLP and a leader in the fields of executive advocacy, employment litigation and arbitration.  He has been a trusted advisor to successful businessmen and women for more than 30 years, regularly counselling them in complex, high stakes employment and personal matters.  How to most effectively enter, maintain and exit the different types of legal and contractual arrangements that surround the workplace is the focus of his practice, including employment and consulting agreements, partnership and operating agreements, non-compete and non-solicit agreements, and separation agreements, among others.   Although conflict avoidance is always the goal, it is not always possible in today's litigious world.  In that regard, Mr. Kraus is highly regarded for his skills in employment mediation, litigation and arbitration which means he has the tools to achieve the best results when disputes do arise.  The knowledge that he has the ability to successfully resolve disputes when they arise often allows his clients  to avoid them from the outset.  Mr. Kraus' clients generally are successful businessmen and women who seek a close and personal relationship with a business oriented, practical advisor who understands that the law is a means to an end, not an end in itself.

Mr. Kraus regularly mediates and arbitrates before all the major dispute resolution providers and litigates in both state and federal court.   He has direct experience with a wide variety of employment and commercial business disputes, including types of breach of contract claims; statutory claims for unlawful retaliation, discrimination, wage and hour violations; economic and common law tort claims such as fraud, intentional interference with contractual relations, and libel and slander.  He has represented a number of whistleblowers with great success.  Mr. Kraus has obtained multiple seven figure damage awards and settlements on behalf of executives and professionals in a variety of industries, including financial services, sports and entertainment, retail, diversified industrial, real estate and a number of others.  

Mr. Kraus regularly lectures before various bar association and trade groups on executive advocacy, employment law and related business issues, including whistleblower laws, non-compete and other restrictive covenants, employment contracts, executive pay, arbitration, arbitration rules and strategy, mediation, cross-border litigation, privacy, and discovery and damages.  Mr. Kraus is active in several major bar associations, including the American Bar Association, where he is currently co-chair of the ADR committee in the Labor and Employment Law Section.   Mr. Kraus earned his undergraduate degree with Honors from the University of Michigan, and received his law degree from Georgetown University School of Law.
